Construction Team Wins Summary Judgment

The Cullen and Dykman Construction Team was able to secure summary judgment for its clients in a negligence case where the plaintiff sustained a severe fracture outside of its facility.  The plaintiff allegedly fell due to a claimed roadway defect that was comprised of deteriorated concrete slabs and a crack-like depression. The Construction Team utilized the plaintiff’s testimony, a critical non-party deposition and secured key photographs of the alleged condition. The court found that the photographs and deposition testimony that we presented, supported our client’s arguments that the condition was trivial/open and obvious, and did not meet the definition of a trap-like snare for which the precedent would support a liability finding.
