Construction Group Continues to Lead Fraud Response With Latest Victory

The Construction Group won another case that had serious fraud implications this month. Plaintiff claimed he was rolling a mini-dumpster filled with heavy demolition debris when the dumpster tipped over, causing him to fall off of a ramp and onto his back. He claimed his injuries prevented him from working ever again. The investigation revealed that the incident was not reported to the supervisors. The testimony from Plaintiff was that his foreman witnessed the incident but the foreman denied that he ever witnessed or knew about it. Our attorneys were able to work with the workers’ compensation case attorneys to have the compensation case thrown out. We then alerted the Court and Plaintiff’s counsel demanding that the case be dismissed or civil fraud counterclaims and affirmative defenses would be pursued. The result was that the plaintiff and its counsel dropped the suit and discontinued it with prejudice.

There are now over 15 cases in the last year that the Construction Group has won either getting dismissed or discontinued where it raised/pressed civil fraud counterclaims and affirmative defenses.
